Pracując w Harvard Law School, rozwinął program socjologicznej jurysprudencji, która zakładała, że prawo powinno ulegać ciągłym zmianom, być platformą ujawniania się aktualnych interesów społecznych i pokojowego rozstrzygania konfliktów między nimi. W tym celu badacze prawa powinni ściśle współpracować z socjologami, politologami i psychologami. Program ten można uznać za początek ruchu amerykańskiego realizmu prawniczego. Zarówno dla jurysprudencji socjologicznej, jak i dla realizmu prawniczego założeniem wyjściowym było uznanie, że prawo to nie tylko normy wyrażone przez prawodawcę w tekstach aktów normatywnych (law in books), ale również faktycznie funkcjonująca praktyka (law in action).
